VANCOUVER, British Columbia — Animal Rights Advocate Marie-Louise Felicia Allen has filed her Appellant's Factum in the British Columbia Court of Appeal advancing her appeal of a lower court decision that struck her constitutional petition without a hearing on its merits.
The appeal concerns Ms. Allen’s challenge to provisions of British Columbia’s Prevention of Cruelty to Animals Act, specifically the authority to seize animals under sections 11 and 12 when those animals are already receiving active veterinary care from a licensed veterinarian. Ms. Allen argues that the seizure of animals under those circumstances raises issues under section 7 of the Canadian Charter of Rights and Freedoms, including liberty, security of the person, and principles of fundamental justice.
A hearing date for the appeal has not yet been scheduled.
