Vancouver, BC – A landmark legal battle will soon be unfolding in the BC Supreme Court as a local pet guardian challenges the constitutionality of the British Columbia Society for the Prevention of Cruelty to Animals (BC SPCA) animal enforcement practices with its seizure from people of their pets and animals in veterinary care.
“This landmark case raises critical questions about the rights of pet guardians all over Canada under Section 7 of the Canadian Charter of Rights and Freedoms,” said a spokesperson for the Society For British Columbia Public Guardians And Animals (BC SPGA), “Since there are SPCA societies all over the provinces and most territories in Canada.”
The petitioner contends that under the current practices of the BC SPCA, pets undergoing veterinary care can be allegedly unjustly seized infringing upon the constitutional rights of pet guardians.
The challenge seeks to affirm that individuals have the right to care for and protect their animals particularly at crucial moments when they require medical attention.
"This case is not just about one pet guardian; it is about the fundamental rights of all Canadians who cherish their pets." said a spokesperson for the BC SPGA. "We support the belief that the actions of the BC SPCA in seizing animals while receiving veterinary care are not only detrimental to the animals but also violate the rights of their guardians guaranteed under the Charter all over the country."
“When you have a police force like the BC SPCA’s animal enforcement with no independent oversight, you have a small group of people with enormous power to destroy the lives of those without.” Said a spokesperson from the BC SPGA.
The hearing by the court of the petition could continue to the highest court in the country is projected to cost British Columbia taxpayers millions of dollars.
“Had the Attorney General listened to the angry emails that she received from all over British Columbia in response to the BC SPGA’s Campaign For Justice For Animals And People With Pets In Veterinary Care,” a spokesperson for the BC SPGA said, “She could have saved taxpayers the expense of fighting the constitutional rights of people who take care of their pets while the provincial deficit plummets to over a projected $11 billion deficit for the fiscal year.”
The hearing of the petition is scheduled for February 25, 2026 at 10:00am in the B.C. Supreme Court. At the time of writing, the respondent B.C. Attorney General ministry has not filed a Response.------------
