Animals that the BC SPCA say are in critical distress they can kill and the public is not entitled to a review.

The BC SPCA found a loophole in the law that enables them to avoid a public review of pets that they kill.

The BC SPCA has found a way to keep the public from knowing about their animal seizure investigations when they claim that a pet is in critical distress and kill the animal.

The BC SPCA in fact calls those types of investigations "moot" and the Supreme Court upon consideration of the BC SPCA law agreed.

The loophole enables the BC SPCA to seize animals and kill them by hiring a veterinarian who deems that the pet is in critical distress despite the pet owner veterinarian's treatment of the pet.

When the BC SPCA hired veterinarian agrees with the BC SPCA enforcement officer that the pet is in 'critical distress' there is no review of the entire investigation under the law written for BC SPCA animal policing.

The BC SPGA believes that the practice of declaring investigations "moot" and the public having no access to the BC SPCA's investigation under the Freedom Of Information and Protection Act is yet another unfair and unjust practice against the pet owner and animal guardian public demonstrating the lack of transparency and secretive operations of the animal policing section of the BC SPCA.

The BC Animal Guardian Act

The BC SPGA is proposing a BC Animal Guardian Act which has protections for animal guardians prior to their pets being seized - such as the right to consult with a veterinarian and or if the animal is under the traatment of a veterinarian to end the investigation - as described in the Society's Position Statement:.

Protection From Animal Seizures
BC Animal guardians with sick, injured or elderly animal(s) in treatment with veterinarian(s) are protected from animal seizures and prosecution.
